Terms of Use for
AllSides Bias Checker™

Please read these Terms of Use for AllSides Bias Checker™ ("Terms") carefully before pressing or clicking the “I Accept” button. By pressing or clicking "I Accept," you or your organization (you or your organization, as the case may be, is referred to as “you” or “your”) agree to be bound by these Terms. Pressing or clicking the “I Accept” button is a legally valid way to create a binding contract between you and AllSides Technologies, Inc. (“AllSides”) under applicable law and constitutes your electronic signature to these Terms. 

If you do not accept these Terms, do not press or click “I Agree” and you are not authorized to access or use the AllSides Bias Checker™ (“Bias Checker”). The person pressing or clicking “I agree” represents and warrants to AllSides that they have the authority to enter into these Terms on behalf of their organization and that their organization agrees to be bound by all terms and conditions of these Terms. 

1. Bias Checker Generally. The Bias Checker allows you to provide the URL of a webpage to AllSides and receive (i) an AllSides Bias Rating, (ii) an AllSides Bias Chart designation, (iii) a short summary of the text of the webpage and its bias, and (iv) an identification and explanation of the biases reflected in the webpage (collectively, “Bias Checker Outputs”). Some customers approved by AllSides in writing will also be able to provide textual materials instead of providing a URL. Certain results provided by AllSides are produced through the use of generative artificial intelligence, currently ChatGPT, utilizing AllSides’ proprietary prompts. Providing a URL or providing text to the Bias Checker for a rating is considered a single “Use.” 

2. Creation of Account. In order to access and use the Bias Checker, you must create an account with AllSides. AllSides customers who are already Sustaining Members do not need to register a separate account, but they are required to agree to these Terms. 

3. Free Uses. When you create an account, you will be provided with a number of free Uses. If you are a Sustaining Member, you will also be provided a number of free Uses, depending on your level of Sustaining Membership, accessible through your Sustaining Member account. 

4. Additional Uses. If you desire to use more than the number of free Uses you have been provided, you may purchase additional Uses. If you have a free account, you must become a Sustaining Member in order to purchase additional Uses. Unless otherwise expressly agreed by AllSides, additional Uses must be purchased in advance, using a credit card. You agree to pay AllSides for all additional Uses that you order. 

5. License to Bias Checker Outputs. You may use the Bias Checker Outputs for your and your affiliates’ internal use for any purpose. The Bias Checker Outputs may also be disclosed or used for commercial or non-commercial purposes but only so long as you attribute the Bias Checker Outputs to AllSides in accordance with the branding guidelines set forth at https://www.allsides.com/trademark-guidelines, as modified from time to time and which is incorporated into these Terms. All other rights and licenses to the Bias Checker, the software that operates the Bias Checker, and the Bias Checker Outputs are expressly reserved to AllSides, and no rights are granted to you by implication.

6. Bias Checker Outputs. AllSides cannot control all content provided by virtue of the use of generative artificial intelligence. By using the Bias Checker, you may be exposed to Bias Checker Outputs that you may find offensive, indecent, incorrect, or objectionable. You agree that under no circumstances will AllSides be liable in any way for any Bias Checker Outputs, including any errors or omissions in any Bias Checker Outputs, or any loss or damage of any kind incurred as a result of your use of any Bias Checker Outputs.

7. Responsibility for Your Inputs. You are responsible for all text, images, data, audiovisual materials, or other information on any webpage to which you, or anyone using your account, provide the URL to the Bias Checker and all text, images, data, audiovisual materials, or other information you, or anyone using your account, upload to the Bias Checker (collectively, “Your Inputs”). You grant AllSides the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute Your Inputs on and through the Bias Checker. You retain any and all of your rights to Your Inputs and you are responsible for protecting those rights. You represent and warrant to AllSides that (i) Your Inputs are yours (you own it) or you have the right to use it and grant AllSides the rights and license as provided in these Terms, and (ii) the posting of Your Inputs on or through the Bias Checker does not violate the privacy rights, publicity rights, copyrights, trade secret rights, confidential information rights, contract rights, or any other rights of any person or entity. You may not transmit Your Inputs to AllSides or the Bias Checker that are unlawful, offensive, upsetting, intended to disgust, threatening, libelous, defamatory, obscene, or otherwise objectionable. Examples of objectionable types of Your Inputs include, but are not limited to, the following:

• Unlawful or promoting unlawful activity.
• Defamatory, discriminatory, or mean-spirited content, including references or commentary about religion, race, sexual orientation, gender, national/ethnic origin, or other targeted groups.
• Spam, machine – or randomly – generated, constituting unauthorized or unsolicited advertising, chain letters, any other form of unauthorized solicitation, or any form of lottery or gambling.
• Containing or installing any viruses, worms, malware, trojan horses, or other content that is designed or intended to disrupt, damage, or limit the functioning of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any data or other information of a third person.
• Infringing on any proprietary rights of any party, including patent, trademark, trade secret, copyright, rights of publicity, or other rights.
• Impersonating any person or entity including AllSides and its employees or representatives.
• Violating the privacy of any third person.
• False information and features.

AllSides reserves the right, but not the obligation, to determine whether any of Your Inputs are appropriate and comply with these Terms, and if AllSides determines in its sole discretion that they are not, may refuse or remove Your Inputs. AllSides further reserves the right to make formatting and edits and change the manner of Your Inputs. 

8. No Web Scraping. A human being must be actually involved in providing Your Inputs for each individual Use. You are not licensed or authorized to use, and you agree that you will not engage in, facilitate, or support any form of data extraction or data harvesting from, the Bias Checker, including, but not limited to, screen scraping, web scraping, data scraping, data mining, and any other automated collection of Bias Checker Outputs without the express written permission of AllSides. Without limiting the generality of the foregoing, you may not use any robot, spider, scraper, or other automated means to access the Bias Checker without AllSides’ express written permission.

9. Intellectual Property. The Bias Checker is protected by copyright, trademark, patent, and other laws of both the United States and foreign countries. The Bias Checker (excluding Your Inputs provided by you or other users), features, and functionality are and will remain the exclusive property of AllSides and its licensors. AllSides’ trademarks and trade dress may not be used in connection with any product or service without the prior written consent of AllSides.

10. Indemnification. You agree to indemnify, defend, and hold harmless AllSides and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses, including, without limitation, attorneys’ fees, arising from your use of the Bias Checker.

11. Privacy. You agree that AllSides may use Your Inputs and any other information or content provided to the Bias Checker or otherwise to AllSides by you or on your behalf in accordance with AllSides’ Privacy Notice, found at https://www.allsides.com/privacy, as modified from time to time, which is incorporated into these Terms. 

12. DISCLAIMER OF WARRANTIES. THE BIAS CHECKER IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

13. Amendments to these Terms. AllSides reserves the right to modify these Terms at any time. You will be notified of any changes through the Bias Checker, on AllSides’ website, or by email. Your continued use of the Bias Checker after any modifications will constitute your agreement to the new Terms.

14. Limitation of Liability. AllSides will not be liable to you for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from the use of or inability to use the Bias Checker, even if AllSides has been informed of the possibility of those damages. In no event will AllSides be liable to you for more than the fees you have paid for the use of the Bias Checker in the twelve months immediately prior to the claim.

15. Existing Website Terms of Use. In your use of AllSides’ website, at www.allsides.com, you agree to be bound by the Terms of Use set forth from time to time on the website (“Website Terms of Use”), which may be accessed at https://www.allsides.com/terms-of-use and which is incorporated into these Terms. If there is a direct conflict between the Website Terms of Use and these Terms, these Terms will control. 

16. Governing Law. These Terms are governed by and will be construed in accordance with the laws of the state of Colorado, without giving effect to any principles of conflicts of law.

17. Termination. AllSides may terminate this Agreement and your access to the Bias Checker at any time without notice if you breach these Terms. AllSides may also terminate your use of the Bias Checker at any time for any reason or no reason, except upon such a termination, AllSides will refund you a prorated amount of fees you have actually paid for any unused Uses.

18. Miscellaneous. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms constitute the entire agreement between you and AllSides regarding the use of the Bias Checker. You and AllSides acknowledge that you and AllSides may have entered into and may in the future enter into other agreements that do not relate to the use of the Bias Checker. Unless expressly stated otherwise, those agreements will not terminate, merge with, or otherwise modify these Terms.
