This week, the Supreme Court allowed a ban on gender-affirming care for minors to go into effect in Idaho while legal challenges against the law proceed. Their decision is a win for those advancing anti-trans arguments in the sober guise of judicial process. It’s also a disturbing indicator of how much weight the conservative majority on the highest court afford such arguments. (Worthy News) – The US Supreme Court ruled Monday that Idaho can criminalize the provision of sex-change treatments to minors, Reuters reports. The Court was divided in its ruling, with the three Democratic-appointed justices dissenting. The case arose after Idaho’s Republican-controlled Legislature passed the Vulnerable Child Protection Act, prohibiting treatments including puberty blockers, hormones and mastectomies that are “inconsistent with the child’s biological sex.” The Act provides that those who violate the law can face up to 10 years in prison.

It is hard to rationalize Idaho’s or any state’s compelling interest in criminalizing Transgender Treatment for Minors, legislation directed solely at a tiny minority group seeking medical intervention for identified and diagnosed conditions. Idaho’s legislation meets all of the tests for a Bill of Attainder and, as today’s NYT headline opines, “ Supreme Court Clears Way, for Now, for Idaho to Ban Transgender Treatment for Minors”, SCOTUS shows its willingness to ignore Article 1, Section 9, Clause 3 of the Constitution. “ No Bill of Attainder …shall be passed.” A...

The U.S. Supreme Court on Monday granted Idaho's emergency request to temporarily revive a state law banning gender-affirming care for children under the age of 18. The law, which makes it a felony for doctors to medically treat gender dysphoria in minors, will now go into effect except in the case of two anonymous plaintiffs who have until now been treated with hormones and may continue to receive treatment. The Supreme Court on Monday allowed Idaho to enforce a controversial ban on gender-affirming care to minors as the law is appealed, temporarily reintroducing one of more than a dozen state bans on gender-affirming care, an increasingly hot-button issue for the GOP.

The Supreme Court approved a stay on a federal District Court decision, allowing Idaho to enforce the ban, with the high court’s conservative justices forming the majority opinion and its three liberal justices dissenting.

WASHINGTON — A divided Supreme Court on Monday allowed Idaho to mostly enforce a law that bans gender-affirming health care for transgender teens. Granting an emergency request filed by Idaho officials, the court said the law enacted last year could go into effect statewide but cannot be applied against the two plaintiffs who challenged it. The court's three liberal justices objected to the decision, saying the law should have remained blocked in full.
