Fact Checkers are disputing Republicans claiming that President Joe Biden was deemed “unfit to stand trial.”
For Context: In Special Counsel Robert Hur’s report earlier this month, he characterized Biden as a “sympathetic, well-meaning, elderly man with a poor memory” and concluded that “the evidence is not sufficient to convict” Biden and that “no criminal charges are warranted” regarding the president’s handling of classified materials.
Unfit For Trial? A number of Republican commentators, including Dan McLaughlin (Right bias) in the New York Post Opinion (Right bias), interpreted Hur’s conclusion as meaning Biden is unfit to stand trial. McLaughlin wrote, “If Joe Biden is unfit to stand trial, he’s unfit to be president,” Additionally, 84 House Republicans signed a letter to Biden stating, “If you are too mentally impaired to stand trial, as your own Department of Justice claims, then we are concerned that your mental state is not at a competent level to serve as the leader of the free world.”
Fact Checkers: An article in FactCheck.Org (Lean Left bias) disputed the claim that Hur deemed Biden unfit to stand trial, writing that Hur’s conclusion was that Biden’s memory issues “might make him a more sympathetic witness, causing a jury to give him the benefit of the doubt.” Echoing this, a Newsweek Fact Check (Center bias) article concluded that “While Hur's judgments in the report may have been embarrassing, they do not state … that Biden would be mentally unfit to stand trial either now or in the future.”
