The Supreme Court handed down a brief order on Tuesday that will prevent violent criminals and other individuals who are not allowed to have guns from evading a federal law requiring background checks for gun buyers. The vote was 5-4, with Chief Justice John Roberts and Justice Amy Coney Barrett joining the Court’s three Democratic appointees.

The case, known as Garland v. VanDerStok, concerns so-called “ghost guns,” dismantled firearms that are sold in ready-to-assemble kits.

Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) Director Steve Dettelbach was unable to define the term “assault weapon” during his agency’s Tuesday budget request hearing  before a House Appropriations subcommittee.

The Biden administration took action Tuesday to close a "ghost gun" loophole following an August rule issued by the Bureau of Alcohol, Tobacco, Firearms and Explosives .

ATF sent an open letter to "all federal firearms licensees" outlining how a number of "partially complete, disassembled, or nonfunctional" gun kits are now classified as "readily" available weapons, requiring each to carry a serial number and for dealers to run background checks prior to sales.

It ought to be hard to believe — but, alas, it’s not — that with the border disintegrating and with it our security and sovereignty, the Biden administration and Washington Democrats are prioritizing . . . yes . . . wait for it . . . ghost guns!

Law enforcement officers across the country increasingly find there is no way to trace certain guns they recover from crime scenes. Because these guns are not marked with serial numbers, there is no way to track their origins or their owners. And because they are sold without a background check, anyone can buy them. 

They truly are "ghost guns."

These unmarked guns are easy to buy, particularly in the form of a build-your-own kit that allows someone to quickly turn parts in a box into a gun capable of firing a bullet.

Why it matters: With gun violence ravaging communities across America, the Biden administration is looking for administrative solutions to address the proliferation of illegal firearms.

President Biden withdrew the nomination of David Chipman to serve as director of the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) on Thursday amid bipartisan concerns about his past gun control advocacy.

Mr. Biden tapped Chipman in April to lead the agency, which has not had a Senate-approved director since 2015. It's unclear when the president will name a new nominee. 

Some House Republicans are pushing a resolution to impeach David Chipman, President Biden's nominee to run the Bureau of Alcohol, Tobacco and Firearms (ATF) – even before he's been confirmed by the Senate.

The effort, which is more political messaging than anything, is led by Rep. Matt Rosendale, R-Mont. It comes as at least five moderate Democrats remain undecided on the controversial nominee with a history of working for major gun control groups, and as the timing for Chipman's final confirmation remains unclear.

President Joe Biden’s nominee to lead the Bureau of Alcohol, Tobacco, Firearms, and Explosives was stumped during his confirmation hearing when he was asked to define an “assault weapon."

“I got 35 seconds left, define it for me, would you please, sir. What's an assault weapon?” Sen. John Kennedy asked ATF nominee David Chipman on Wednesday.

"There's no way I could define an assault weapon," Chipman said.

“I'll give you one definition that ATF currently uses" Chipman continued, as Kennedy interjected that he wanted Chipman’s personal definition.

Regulations might reshape DIY gun products, but they can’t eliminate the demand that created the industry.
