With Justice Stephen Breyer’s reported retirement opening a seat on the Supreme Court, President Joe Biden has a chance to fulfill a campaign promise to name a Black woman to the Court for the first time.

The announcement of Justice Stephen Breyer’s retirement has whistled the start of that Washington blood sport known as a Supreme Court confirmation. While the filibuster-free process guarantees President Joe Biden that he has the votes to pick anyone acceptable to all Senate Democrats, this fight is different from any in history in one respect. As a candidate, Mr. Biden pledged to select the next justice first and foremost on race and sex.

The Supreme Court blocked the Biden administration from enforcing its emergency rule mandating that workers at large businesses get vaccinated or undergo regular testing for COVID-19, a major setback for the president’s national vaccination effort.

However, the court decided to allow the administration to proceed with a vaccine mandate for health care workers at federally funded facilities.

The Supreme Court on Thursday blocked the Biden administration from enforcing its sweeping vaccine-or-test requirements for large private companies, but allowed a vaccine mandate to stand for medical facilities that take Medicare or Medicaid payments.

The rulings came three days after the Occupational Safety and Health Administration’s emergency measure for businesses started to take effect.

The Supreme Court temporarily suspended the Biden administration’s vaccine-or-test mandate for large employers on Thursday, but allowed the administration’s vaccine mandate for health-care workers at facilities that receive federal funding to go into effect.

To the extent President Biden’s pull-out from Afghanistan was not criminally negligent, it was pervasively mendacious.

The Supreme Court said Friday that Justice Brett Kavanaugh has tested positive for COVID-19.

Driving the news: Kavanaugh, who has been fully vaccinated since January, has no symptoms, per the Court.

Kavanaugh learned of his positive case on Thursday evening after being tested as part of the Court's "regular testing protocols."

A group of Democratic senators is demanding more answers from the FBI after the agency revealed new details about the limited scope of its supplemental investigation into Brett Kavanaugh's background when he was a nominee for the Supreme Court.

In a letter June 30 to Sens. Sheldon Whitehouse, D-R.I., and Chris Coons, D-Del., made public Thursday, Jill Tyson of the FBI's congressional affairs office acknowledged that the department conducted only 10 additional interviews in its supplemental investigation, even though it had received over 4,500 tips.

Senate Judiciary Committee Democrats are criticizing the FBI over its handling of the tip line in its investigation of the sexual misconduct allegations of now-Supreme Court Justice Brett Kavanaugh.

The Democrats, led by Sens. Sheldon Whitehouse (R.I.) and Chris Coons (Del.), wrote a letter to FBI Director Christopher Wray on Wednesday seeking answers after the agency revealed it gathered more than 4,500 tips in relation to its investigation of the claims against Kavanaugh.
