The federal judge who oversaw the classified documents case against President-elect Donald Trump issued an order Tuesday temporarily blocking the release of special counsel Jack Smith’s report on his investigation.

The injunction lasts until three days after the 11th U.S. Circuit Court of Appeals rules on a pending request to block the release of the report over a separate matter involving Trump co-defendants Walt Nauta and Carlos De Oliveira.

Attorneys for Donald Trump have asked attorney general Merrick Garland to stop special counsel Jack Smith from completing his report detailing his investigations of the president-elect. Should Garland decline to do that, they propose that the decision to release the report be made by whoever becomes attorney general when Trump takes office.

Special counsel Jack Smith said Tuesday that his team was finalizing a two-volume report on its investigations into President-elect Donald Trump and that at least one volume of it could be released by the Justice Department as early as Friday.

The disclosure came in response to a request by defense lawyers, filed in court and in a letter to Attorney General Merrick Garland, to preemptively block the report from being made public.

U.S. District Judge Aileen M. Cannon’s ruling is a remarkable win for Trump, whose lawyers have thrown longshot argument after longshot argument to dismiss the case. Other courts have rejected similar arguments to the one that he made in Florida about the legality of Smith’s appointment.

Judge Aileen Cannon dismissed the case against the presumptive Republican presidential nominee on the grounds that the appointment of special counsel Jack Smith to the case violated the Constitution.

Cannon ruled that Congress was required to appoint “constitutional officers” and the legislature was also needed to approve spending for such a prosecution.

The ruling hands a major victory to Trump, marking the first time one of his four criminal cases has been dismissed entirely. 

“The Superseding Indictment is dismissed because Special Counsel Smith’s appointment violates the Appointments Clause of the United States Constitution,” Cannon wrote in a 93-page ruling. 

Special counsel Jack Smith accused former President Donald Trump of pressuring his vice president to derail the election certification in January 2021.

Trump’s interactions with Mike Pence were among several key acts Smith used to bring his election interference indictment against Trump, but the special counsel may now have to scrap these acts because of the Supreme Court’s decision on Monday.

He’s poorly positioned to assist Joe Biden when he needs it most.

No matter how favorable the presidential race has looked for Donald Trump, there’s always been the possibility that special counsel Jack Smith would get to trial with his January 6 case before the election and, at the very least, dominate the news cycle for weeks and, in all likelihood, convict Trump in a case involving more serious matters than hush money to a porn star.
