A man who leaned over a plate of sizzling fajitas to pray can't sue a Westampton restaurant because the dish burned him, an appellate court ruled Wednesday.

Hiram Jimenez sought damages from Applebee's Neighborhood Grill and Bar after a March 2010 incident at the chain's restaurant on Burlington-Mount Holly Road. But an appellate panel said Applebee's can't be held responsible because the hot food posed an "open and obvious" danger.

The Supreme Court gave limited approval on Monday to public prayers at a New York town's board meetings.

The Supreme Court says prayers that open town council meetings do not violate the Constitution even if they routinely stress Christianity.

In a case to be heard Wednesday, the Supreme Court will decide if judges can decide the types of prayers that can be spoken in a government setting.

A challenge to the way a western New York State town board has had prayers read before its public meetings has made its way to the U.S. Supreme Court.

The justices announced Monday morning that they will hear oral arguments in the case of Greece, N.Y. v. Galloway, Susan.

The issue, as SCOTUSBlog writes, is whether a federal appeals court was right when it ruled that the town board's practice violates the Constitution's Establishment Clause, which reads:

"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or
