Harvey Weinstein’s New York rape conviction was overturned Thursday by New York state’s highest court, which ordered that the disgraced Hollywood mogul should face a new trial.

In a 4-3 ruling, the New York State Court of Appeals found that a Manhattan judge “erroneously” allowed testimony from three women whose allegations weren’t connected to the case.

Disgraced movie producer Harvey Weinstein has been sentenced in California to 16 years for sexual assault. Weinstein is already serving a 23-year prison sentence in New York for criminal sexual assault and third-degree rape.

Superior Court Judge Lisa B. Lench sentenced the 70-year-old Weinstein in a downtown Los Angeles courtroom on Thursday after denying a defense motion for a new trial. 

Harvey Weinstein was found guilty of one count of rape and two counts of sexual assault in a mixed decision Monday.

He was found guilty of all counts of rape and sexual assault pertaining to Jane Doe 1, but the jury acquitted him of sexual battery against Jane Doe 3 and was hung on the three other counts against him from Jane Doe 2 and Jen Newsom.

The jury came to its decision after about 10 days of deliberation, with both sides resting their case on Dec. 2.

Harvey Weinstein, currently serving a 23-year sentence for sex crimes in New York, is back on trial on criminal charges in Los Angeles, the city where he once held sway as one of the most powerful producers in Hollywood.

Weinstein, 70, is facing 11 charges of rape and sexual assault involving five women in the Beverly Hills and Los Angeles area between 2004 and 2013. Opening arguments are expected to start on Monday. Weinstein has pleaded not guilty.

Harvey Weinstein’s lawyer is not thrilled with the conditions of his client’s holding cell where he’s awaiting trial.

The disgraced Hollywood film producer is currently standing trial in Los Angeles for several sex crime charges revealed five years ago during the height of the #MeToo movement. Weinstein’s lawyer, Mark Werksman, told the judge Tuesday that his client’s accommodations were unacceptable and that he didn’t even have a place to use the bathroom.

Harvey Weinstein, a convicted sex offender once revered as one of Hollywood’s most influential power brokers, will finally be extradited to Los Angeles to face additional rape and sexual assault charges. Weinstein, 69, is currently serving a 23-year prison sentence in the Wende Correctional Facility near Buffalo, New York, for sexually assaulting former Project Runway production assistant Miriam Haleyi and raping former actress Jessica Mann. Los Angeles prosecutors allege Weinstein also sexually assaulted at least five women between 2004 and 2013.

Two women who testified against disgraced Hollywood producer Harvey Weinstein have thrown their support behind a new bill that seeks to define "consent" and clarify lawful sexual conduct in New York state.

New York Assembly Member Rebecca Seawright announced bill A6540 on Monday, which defines consent as a "freely given, knowledgeable and informed agreement" obtained without the use of "malice such as forcible compulsion, duress, coercion deception, fraud, concealment or artifice."
