Florida became the first state to win FDA approval for a program to import cheaper versions of certain medications in bulk from Canada.

The Details: The authorization lasts for two years and requires imports to “significantly reduce the cost to the American consumer without imposing additional risk to public health and safety.” Florida is also required to ensure imported drugs are tested for authenticity and compliance with FDA standards.

For Context: While individuals can purchase drugs from Canadian pharmacies, state governments are usually limited to higher-cost U.S. medicines for programs like Medicaid, since the FDA cannot guarantee the safety of imported drugs. American pharmaceutical companies have also cited safety in their opposition to cheaper imports.

Bipartisan Support: Congress allowed bulk import programs decades ago, but federal health officials delayed their implementation over safety concerns. However, former President Donald Trump allowed states to submit proposals in 2020, and President Joe Biden pushed the process forward with an executive order. The FDA’s decision is also a win for Florida Gov. Ron DeSantis, who supported the move and sued the FDA in 2022 for allegedly delaying the approval process.
