Texas Governor Greg Abbott pardoned Daniel Perry, a U.S. Army Sergeant convicted for shooting and killing Garrett Foster, a Black Lives Matter protester, in 2020.

For Context: In the summer of 2020, while driving his car through a protest group, Perry claimed Foster, who was carrying an AK-47, pointed the firearm at him, prompting Perry to shoot in self-defense. Foster, an Air Force veteran, was participating in one of many demonstrations nationwide protesting police brutality and racial inequality. Multiple witnesses reportedly testified during the trial that Foster wasn't pointing his gun at Perry when the fatal incident occurred. Perry was sentenced to 25 years in prison for the killing. 

Details: The Texas Board of Pardons and Paroles unanimously recommended the pardon after reviewing Perry's personal history and the 2020 incident’s facts. The decision was justified utilizing Texas' 'Stand your Ground' laws, with Abbott insisting the law of self-defense could not be nullified by the jury or a progressive District Attorney. However, many, including Foster's family, criticized the decision and questioned the potential consequences such a decision could create in an open-carry state like Texas.

Garrett Foster's family is speaking out about the Gov. Abbott's decision to pardon Daniel Perry, who was convicted of murder after a 2020 Black Lives Matter protest in Austin. 

"I think they're using my dead child to make a political statement," said Garrett's mother, Sheila Foster.

Her heart still aches nearly four years after losing her son.   

Garrett was a 28-year-old Air Force veteran when he joined Black Lives Matter protesters in Downtown Austin in the summer of 2020, along with his fiancé Tiffany. 

The father of a North Texas native killed during an Austin protest in 2020 criticized Texas Gov. Greg Abbott’s full pardon for the man convicted of murder in the case.

Abbott announced the pardon just minutes after the Texas Board of Pardons and Paroles disclosed it had made a unanimous recommendation that Daniel Perry be pardoned and have his firearms rights restored, The Associated Press reported.

Perry has been held in state prison on a 25-year sentence since his 2023 conviction for fatally shooting Garrett Foster.

Texas Governor Greg Abbott issued a pardon to U.S. Army Sergeant Daniel Perry, citing the state’s Stand Your Ground laws and the right of self-defense. Perry was convicted by a Travis County court in April 2023 for shooting and killing Garret Foster during a Black Lives Matter protest.

“Texas has one of the strongest ‘Stand Your Ground’ laws of self-defense that cannot be nullified by a jury or a progressive District Attorney,” Abbott said in a written statement on Thursday.
