The Supreme Court refused on Thursday to revive a Florida law that banned children from “adult live performances” such as drag shows.

The court’s brief order gave no reasons, which is typical when the justices act on emergency applications, and a First Amendment challenge to the law will continue in the lower courts.

On Friday, a federal judge in Florida blocked a law preventing minors from attending drag shows, ruling that the statute violated the First Amendment rights of an Orlando-based restaurant. While attempts at banning or restricting access to drag performances have swept local governments and state legislatures, most have failed to pass legal muster. 

Clayton Kershaw, a star pitcher for the Los Angeles Dodgers, criticized his baseball team in a recent interview for including the Sisters of Perpetual Indulgence in its upcoming gay pride night.

The Sisters of Perpetual Indulgence is a self-described “leading-edge Order of queer and trans nuns” with a reputation for satirizing and insulting Christian communities.

The Texas Senate on Wednesday approved two bills aimed at restricting drag performances that children attend or see. One of them, Senate Bill 1601, would defund public libraries where drag queens are allowed to read to children. The other, Senate Bill 12, bars kids from drag shows if the performances are overly lewd and lascivious.

SB 12, which is a priority for Lt. Gov. Dan Patrick this session, was approved in a 20-11 vote. Sen. Royce West of Dallas was the only Democrat to vote yes for SB 12.

Last April, when drag could still be performed in Tennessee without noticeable complaint, the curtains parted at Tennessee Tech University's Backdoor Playhouse to reveal Joshua Lancaster wearing a black cowl, white face paint, black lipstick and white contact lenses.

He was excited for the debut of his new drag persona, Witchcrafted. But the four-minute video of Lancaster lip-syncing and sashaying across the stage, recorded by his boyfriend, would sit on his Facebook page largely unseen for months until it was found by Landon Starbuck, a conservative activist.

Walter Cole, better known as the iconic drag queen who performed for decades as Darcelle XV and a fearless advocate for Portland’s LGBTQ+ community, has died of natural causes in Portland, Oregon. He was 92.

Darcelle, who died Thursday, was crowned the world’s oldest working drag performer in 2016 by the Guinness Book of World Records and was regaling audiences until the very end. As a performer, Darcelle was known for hosting the longest-running drag show on the U.S. West Coast. Off stage, Cole, an Army veteran, championed LGBTQ+ rights and charitable work in Portland.

Earlier this month, Tennessee Gov. Bill Lee (R) became the first governor to sign into law a bill prohibiting certain kinds of drag performances. More specifically, the bill prohibited “adult cabaret” in locations where minors might be present, including “topless” or “exotic” dancers, but also “male or female impersonators who provide entertainment that appeals to a prurient interest.”
